What constitutes a violation of Rancho Cucamonga Municipal Code Section 6.02.040 Animals That Habitually Make Noise?

In residential zones of the city, it is unlawful for any person(s) owning or having control of one or more animals ("responsible person"), either willfully or through failure to exercise proper control, to allow such animal to habitually or continually bark, howl, crow, or make any other loud noise in such a manner as to at any time, day or night, cause general annoyance or discomfort to a neighboring inhabitant. The standard of general annoyance or discomfort is a "reasonable person" standard, i.e., the noise is such that a reasonable person, under the same or similar circumstances, would suffer more than minor annoyance or discomfort.

When a complaint is received by our Field Services Division regarding a nuisance animal we follow a very simple procedure.  This requires the gathering information from the complainant, contacting the owner of the animal to resolve the issue, provide educational assistance on how to do so if necessary, following up with the owner to ensure the problem is being handled, and restoring peace to the neighborhood. By acting in a neighborly and cooperative manner most nuisance complaints can be resolved without additional enforcement action. It is always recommended that neighbors discuss problems and resolve them together in the most civil manner possible.  If this is not effective or it is not a reasonable option our department can file a nuisance animal noise complaint on your behalf.
